Note:  A new Fee Schedule is in effect as of August 1, 2006.  The new schedule can be found on our "Permit Forms & Fees" page. There is now a plan review fee required for structural permits that is paid when you submit the application and drawings.  For commercial projects the plan review fee is $200.00.
 
Commercial Construction
Commercial projects are defined as any project occurring on property other than residential property. Apartment projects with four or more units are considered commercial projects. Commercial projects requiring permits include certificates of occupancy (for all new tenants), interior remodeling, additions, new buildings, any site work and temporary uses. Many commercial projects involve conditional uses, a Planned Unit Development (PUD) or an Economic Development Overlay (EDO), so it is highly recommended to verify the applicable zoning regulations in the early stages of project planning. Applicable codes:
The Ohio Building Code and related codes are based on the International Codes. It is available for purchase from the International Code Council at www.iccsafe.org. Commercial projects (everything except one-, two- & three- family dwellings) are regulated by the following codes:

Who should make the application?
The owner or the owner’s authorized agent (i.e., contractor or architect).

Who can a permit be issued to?
To the property owner or his authorized agent. Both parties bear responsibility. Note: Sub-trades are regulated by the Ohio Construction Industry Licensing Board and fire protection system installers are regulated by the Ohio Fire Marshal. Plumbers must also be registered by the City of Kettering.

When is a permit required?
When the owner/agent wants to construct, enlarge, alter, repair, move, change the occupancy of a building or structure, or portion thereof
OR
When the owner/agent wants to erect, install, enlarge, alter, repair, remove, convert or replace any electrical gas, mechanical, plumbing system, other building service equipment, or piping system.

Can demolition or construction begin without a permit?
NO! Work that does not require a permit or emergency repairs may proceed. Work conducted without a required permit is subject to a Stop Work Order, Notice of Violation and Adjudication Order requiring removal of the work, double permit fees and/or other penalties prescribed by law.


Commercial construction that requires a permit:

Building/Structural Permits

New buildings
Additions
Interior alterations
Demolition
Tenant improvements
Door hardware
Ramps, stairs, handrails, guardrails
Load-bearing walls
Non-load-bearing walls or partitions
Fire rated assemblies
Canopies, awnings
Change of occupancy (a change in the purpose or level of activity that involves a change in the application of code requirements)
Change in the Use Group classification for all or part of the building;
Certificate of Occupancy

Requiring zoning approval only:

Fences not over 6 ft. high, retaining walls not over 4 ft. high, accessory structures less that 120 square feet in size

Commercial Application Submission Requirements:

Certificate of Occupancy:

Commercial Permit Application Form Part A
Commercial Property Survey Form (usually filled out by the tenant)
Scaled site plan indicating the location of your parking, trash dumpsters, and any site signage (not required for a “name change only”)
Scaled floor plan indicating the Use Group, Construction Type and Occupant Load. If it is a change of Use Group, Occupant Load, or level of hazard, it will require documents sealed by an architect.
Fees are paid upon issuance of the permit (cash, check or credit card).

Building Structural:

Commercial Application Form Part A
Commercial Application Form Part B (Use Group, Construction Type, Occupant Load, etc.)
Three sets of sealed drawings (see the Building Permit Checklist)
Five sets of sealed drawings for new buildings or additions
Drawings sets must include all sub-trade documents.
Fire protection documents may follow at a later date (separate permits).
Pre-engineered truss drawings may be submitted later, prior to installation.
Separate application for Certificate of Occupancy is note required.
Minor alterations not requiring technical analysis may not require sealed drawings.
Plan review fee of $200.00.  This fee is required for structural permits and is paid when you submit the application and drawings.  This plan review fee is applied as partial payment on the permit.  Any remaining balance is paid upon issuance of the permit (cash, check or credit card).
